Privacy Policy

2NIGHT ("we", "us") is a location-based social-discovery app. This policy explains what we collect, why, the legal bases we rely on, and the choices and rights you have. We designed 2NIGHT to collect only what is necessary to help you meet people for real plans tonight.
Who we are
The controller of your personal data is Hugo Moriceau, 8 Le Mail, 74160 Saint-Julien-en-Genevois, France, operating as an individual. For any privacy question, or to exercise any of the rights set out below, write to support@2night.co or to the postal address above. You can also lodge a complaint with the CNIL, the French data protection authority, at cnil.fr.
Information we collect
Account details you provide (name, age, gender, email), your status and plans, approximate and precise location while you are live, profile photos, and messages you send through the app. We also process basic device and usage data (such as device type, app version, and the server logs our hosting produces) to keep the service secure and reliable.
Who you want to see. In the app you can choose who you want to see: everyone, women, men, or non-binary people. We only store that choice on our servers if you tick the box that says so. If you pick "Everyone", nothing is stored on our servers at all — there is nothing to store, because the choice does not narrow anything. If you pick women, men, or non-binary people and you tick the box, we store that one word, alongside a record that you agreed and which version of the wording you agreed to.
A choice like that can say something about your sexual orientation. Under the GDPR that makes it special category data, so we treat it with the extra care Article 9 requires: we ask for it separately, we store it only on your explicit consent, and we delete it the moment you take that consent back. It is never shown to any other member. It does not appear on your profile, it is not in the feed, and there is no way for anyone else to read it.
The waitlist. If you sign up on this website before the app is open where you live, we take your email address and phone number, and your name if you give it. We also record the language your browser asked for and the page that referred you, and the copy held on our own server records your IP address and browser user-agent. We use this to tell you when 2NIGHT opens near you and to work out your place in the queue. A signup also sends the operator an alert containing that entry's name, email and phone. You can ask us to delete your waitlist entry at any time, and we delete it automatically if you later create an account with the same email address and then delete that account.
How we use your information
To show you who's out nearby, deliver the Tonight Feed, enable pings and matches, operate plans and chat, process membership subscriptions, keep the service secure, prevent fraud and abuse, comply with our legal obligations, and improve the product. We do not sell your personal data and we do not share it for cross-context behavioural advertising.
If you have stored a "who you want to see" choice, we use it to filter the feed in both directions: you see someone only if your choice allows them and their choice allows you. If either of you has not stored a choice, no filtering happens on that side — a member without a stored choice still sees everyone and is still seen by everyone.
Legal bases (EEA / UK users)
Where the GDPR or UK GDPR applies, we process your data on these bases: performance of our contract with you (to provide accounts, the Tonight Feed, matching, plans and chat — but not the "who you want to see" choice, which is covered separately below); your consent (for precise geolocation, which you can withdraw at any time via your device settings or by going offline; for storing your "who you want to see" choice; and for any optional analytics, if introduced); our legitimate interests (to keep 2NIGHT secure, prevent fraud and abuse, and improve the product, balanced against your rights); and compliance with legal obligations. Where we rely on consent, you may withdraw it at any time without affecting prior processing.
Special category data — who you want to see
Your "who you want to see" choice can reveal something about your sexual orientation. Data like that gets extra protection under Article 9 of the GDPR, and a contract with you is not a good enough reason to hold it. So we hold it on one basis only: your explicit consent, under Article 9(2)(a). If you have not given that consent, we do not store the choice on our servers, full stop.
Giving it is optional, and declining costs you nothing. If you say no, you keep the whole app. Your feed is not restricted, you are not hidden from anybody, and nobody is hidden from you — you simply see everyone, and everyone can see you. We do not treat a "no" as a reason to show you less.
To take it back, go to Settings → Tonight → Who you see in the app and untick the box, or set your choice back to "Everyone". Either one deletes the stored choice from our servers immediately. There is nothing to email us about and no waiting period. Withdrawing does not undo processing that already happened before you withdrew, and it does not affect anything else in your account.
Location
Location is central to 2NIGHT. You control when you are live. When you set your status, we use your location — with your consent — to surface relevant people near you within the radius your tier allows. You can stop sharing location at any time from your device settings or by going offline in the app.
Sharing and service providers
We share data with service providers who process it on our behalf under data-processing agreements, and with a small number of third parties that your device or browser contacts directly. This is the complete list:
- Supabase — our database, authentication and file storage. Almost everything you put into 2NIGHT lives here.
- Apple — app distribution, Sign in with Apple, subscription billing, and push notifications. A push tells your phone that something happened and who it involves; it never carries the contents of a message.
- Apple Game Center — if you are signed in, we report progress on a handful of in-app achievements (things like your first match, or making a plan). We do not publish leaderboards.
- Apple location services — we send coordinates to Apple to turn them into a city name, and city names back into coordinates.
- Contabo GmbH — the German hosting company that runs this website and the waitlist form.
- Google STUN servers — when you start a video or voice call, your device asks a Google server how it is reachable from the internet. Google sees your IP address in the process. It does not see or carry the call.
- Telegram — a waitlist signup sends the operator an alert containing that entry's name, email and phone number. Nothing about app members goes to Telegram.
- jsDelivr and unpkg — public code libraries this website loads. Your browser's IP address and user-agent reach them when a page loads.
Calls do not pass through us. Audio and video go straight from one phone to the other over WebRTC. That is good for privacy in one way — we never hold your call — and worth knowing in another: the person you are calling can see your IP address, and you can see theirs, the same as on any peer-to-peer call.
We do not use analytics, advertising, attribution or crash-reporting services. There is no tracking SDK in the app.
Other members see only the profile, status, photos and information you choose to make visible. Your "who you want to see" choice is visible to no member — not to the people it filters, not to the people it matches you with, not to anybody. It is not shared with any of our service providers for their own purposes either. We may disclose data where required by law, to enforce our Terms, or to protect the rights, safety and security of our members or the public.
International data transfers
We process data primarily within the European Union. Because 2NIGHT operates worldwide, your data may also be processed in other countries. Where we transfer personal data outside the EEA, UK or Switzerland, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses (and the UK Addendum / Swiss equivalents) or an adequacy decision. You can request a copy of the relevant safeguards by contacting us.
Data retention
We keep personal data only as long as we need it. In practice:
- Account and profile data — kept while your account exists.
- Precise location — kept only while it is useful. If you have not been live for about 30 days, we blur your last position to your city or drop it entirely.
- Messages — kept while your account exists. When you delete your account they go with it, immediately. We do not keep a copy for a year, and we do not keep a copy for any other purpose.
- Your "who you want to see" choice — deleted the moment you withdraw consent, and deleted with your account.
- Safety reports — a report you filed is detached from you when you delete your account. A report somebody filed about you is kept, because deleting it would let anyone erase their own record by making a new account. Those follow the schedule set out in our Guidelines.
- Waitlist entries — deleted when you delete an account using the same email address, or on request.
When you delete your account, the deletion happens straight away, not on a queue. Your profile, photos, videos, messages, matches, plans and stored preferences are removed at once. The only things that survive are safety reports about you, described above, and anything we are legally required to keep.
Your choices and rights
Depending on where you live, you have the right to access, correct, delete, export (portability), object to, and restrict our processing of your personal data, and to withdraw consent at any time. Most of them you can exercise yourself, in the app, without asking us. Settings → Account → Download my data gives you a JSON file containing your profile, your matches, your messages, your plans and your likes. Settings → Account → Delete account erases everything described under "Data retention" above. Settings → Tonight → Who you see shows your stored "who you want to see" choice and lets you change or withdraw it. For anything else, email support@2night.co; we will respond within the time required by law (generally one month under the GDPR). We will not discriminate against you for exercising your rights. If you are in the EEA or UK, you also have the right to lodge a complaint with your local data-protection authority — in France, the CNIL (Commission Nationale de l'Informatique et des Libertés, www.cnil.fr).
California (CCPA / CPRA) notice
In the past 12 months we have collected the categories of personal information described in "Information we collect" (identifiers, account details, precise geolocation, photos, communications and device/usage data) for the purposes described above. We do not sell your personal information and we do not share it for cross-context behavioural advertising. Two of those categories are sensitive personal information under the CPRA: your precise geolocation, and the "who you want to see" choice, which can indicate sexual orientation. We use both only to run the app for you — to show you who is nearby and to filter your feed — and never to infer characteristics about you, to build a profile, or for advertising, which are the uses the right to limit is aimed at. California residents have the right to know, access, correct and delete their personal information, to opt out of any sale or sharing, and to limit the use of sensitive personal information, without discrimination. To exercise these rights, contact us at support@2night.co. Because we do not sell or share personal information, no "Do Not Sell or Share My Personal Information" action is required; if this ever changes, we will provide that option here.
Adults only (18+)
2NIGHT is strictly for adults. You must be at least 18 years old to use 2NIGHT. We do not knowingly collect personal data from anyone under 18. If we learn that we have collected data from someone under 18, we will delete it and terminate the account. If you believe a minor is using 2NIGHT, contact us at support@2night.co.
How we protect your data
We use technical and organisational measures designed to protect your personal data, including encryption in transit, access controls, and restricting access on a need-to-know basis. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a data breach affects your rights, we will notify you and the relevant authorities as required by law.
Cookies and similar technologies
Our website currently uses only essential, first-party storage — needed for the site to work and to remember your choices, such as your language and your cookie preference (stored in your browser as tn_cookie_consent). We do not currently load analytics or advertising cookies. If we introduce optional analytics in the future, we will not set those cookies until you accept them in the cookie banner, and you can change your choice at any time by clearing your browser storage. Declining optional cookies still lets you use the full site.
Changes to this policy
We may update this policy from time to time. We will post the updated version here with a new "Last updated" date and, for material changes, notify you in the app or by email before they take effect.
